St. Enoch Rewards Terms and Conditions


[St Enoch Rewards] (the "Programme”) is operated by St. Enoch Trustee Company Limited (company number 89053) with its registered office at 13-14 Esplanade, St Helier, Jersey JE1 1BD (“St. Enoch Trustee Company Limited”, “we”, “us”, “our”). Members of the Programme will be able to receive benefits, discounts and special offers from participating retailers within St. Enoch Centre (“Offers”). The Offers you have access to may vary from time to time and from person to person.


    Joining the Programme

  1. These terms and conditions (the “Terms”) will govern your membership of the Programme. These Terms tell you who we are, details of the Programme, how we may change or end the Terms, how we use your data, what to do if there is a problem and other important information. Joining the Programme constitutes acceptance of these Terms. Please read these Terms carefully. If you do not agree to the Terms you must not take part in the Programme.
  2. To join the Programme, you should do one of the following:
    1. Register at www.st-enoch.com ("the Website");
    2. Sign up in-store for a loyalty card ("Loyalty Card"); or
    3. Download and register on the St. Enoch Rewards app ("the App").
  3. You will be required to register your email address and other personal details with St. Enoch Trustee Company Limited. Our privacy policy at clause 21 below sets out what personal data we require, how we use your information and how we protect this information.
  4. The App is free to download but downloading the App may incur standard data download rates, please contact your mobile service provider for more details and seek the bill payer’s consent (if applicable).

  5. Participating Retailers

  6. For a list of the retailers who are participating in the Programme(each a "Participating Retailer") please visit our Website. This list may change from time to time and we recommend that you visit the Website regularly to confirm the Participating Retailers. Please note, not all retailers within St. Enoch Centre will be part of the Programme.

  7. Offers and how to redeem them

  8. Details of Offers available to you will be shown on the App and in emails which we send to you about the Programme.
  9. To redeem an Offer you should present the unique bar code on your App/email/Loyalty Card to the Participating Retailer at the point of purchase.
  10. Participating Retailers are responsible for providing the Offers. Offers are subject to availability. It may also be necessary for our Participating Retailers to make changes to Offers which have already been published on the Website or App.
  11. In addition to these Terms, Offers may be subject to terms and conditions imposed by the Participating Retailer making the Offer (for example, closing dates, exclusions, any limits on availability) ("Additional Terms").
  12. As far as possible, any Additional Terms will be provided alongside the Offer. To avoid disappointment, please read the Additional Terms carefully before trying to redeem an Offer.
  13. You may be prevented from redeeming an Offer if:
    1. the Participating Retailer has reason to suspect fraud or misconduct by you or in the way the Offer is being used; or
    2. the Offer was sent to you in error.

  14. Our Responsibility and Liability

  15. Subject to clause 14, we have no responsibility or liability for:
    1. the Offers made by Participating Retailers;
    2. failure of a Participating Retailer to honour an Offer;
    3. in respect of any goods or services which you purchase from a Participating Retailer using an Offer or otherwise; or
    4. any loss or damage suffered by you in connection with using the Programme, (including without limitation, in relation to any transmission delays, failures of the App, damage to any mobile phone, data message delays or any other technical difficulties beyond our reasonable control).
  16. If an issue arises in relation to any of the points listed in clause 12 above, you should contact the Participating Retailer directly to resolve the matter.
  17. Nothing in the Terms shall limit or exclude our liability for:
    1. death or personal injury caused by our negligence, or the negligence of our personnel, agents or subcontractors;
    2. fraud or fraudulent misrepresentation; and
    3. any other liability which cannot be limited or excluded by applicable law.

  18. Cancellation of Offers

  19. From time to time, it may be necessary to withdraw Offers from the Programme. We will endeavour to provide you with prior notice, however it may not always be possible to give advance warning of this.
  20. Whilst we will try to ensure that the scanners and system are available during Participating Retailer store opening hours, you understand that there may be circumstances where the scanner and/or system is unavailable and therefore you will not be able to redeem Offers.

  21. Termination of the Programme

  22. We reserve the right to terminate or suspend the Programme at any time at our discretion and without reason.

  23. Withdrawal from the Programme by Us

  24. We reserve the right to terminate your membership of the Programme at our discretion in the event that:
    1. we terminate the Programme;
    2. we reasonably believe that you have failed to comply with these Terms;
    3. we reasonably believe you have behaved in a way which is fraudulent, inappropriate or illegal; or
    4. if you do not redeem any Offers over any period of 15 consecutive months.
  25. If your membership of the Programme is terminated, then, from the date of termination you will not be able to redeem any Offers

  26. Withdrawal from The Programme by you

  27. If you no longer wish to take part in the Programme, you can do so by simply deleting and/or ceasing to use the App; Loyalty Card; and/or emails.
  28. Privacy Policy
    We are committed to protecting the privacy of members of the Programme and keeping your information secure. This clause provides information about how we process personal information obtained in connection with the Programme. We will not collect personal information from you unless you have agreed to us doing so through your use of the Programme. Please read the following carefully to understand our views and practices regarding your personal data and how we will treat it. By (i) registering on and/or using the App or Website; (ii) signing up in store to a Loyalty Card; or (iii) otherwise taking part in the Programme you agree to your personal information being used and disclosed in the manner set out in this clause.
    1. Information we may collect via The Programme
      When you take part in the Programme, we will collect certain information from you including your name, email address, telephone number and any other information you provide, such as age group, interests and preferences.
      When you use the Website, as is the case with most websites, certain limited information (including your IP address) will be collected by us automatically.
      We may also collect information on your use of the Programme.
    2. How we use personal information
      We will use the personal information collected through the Programme for a number of purposes, including to:
      • register you as a member of the Programme;
      • provide you with details of Offers and enable you to redeem Offers with Participating Retailers;
      • collect statistics about your use of the Programme; and
      • contact you by email or SMS about our new developments, services and any other information we think may be of interest to you based on your use of the Programme.
      We will only use your information where we have obtained appropriate permissions from you and will only use the information in accordance with this clause or where it is required and authorised by law.
      We do not provide any personal information to an unrelated third party unless we have your permission to do so (including as set out in these Terms) or where we are required to do so by applicable law (see "Providing information to others" below).
    3. Providing information to others
      We may pass on your personal information, or allow access to your information:
      • to companies within our group of companies so that they may contact you by email or SMS with details of developments and activities which may interest you (see "Working with other service providers and group companies" below);
      • To our retailers who participate in the program, only in the instance where you joined the program in the retailer’s store, to enable the retailer to contact you directly by email or SMS about their own new developments, services and any other information they think may be of interest to you.
      • to our professional advisors where this is necessary for them to provide services and facilities to us;
      • to any purchaser of all or substantial part of our business or assets;
      • where we are required to do so by law, court order or other legal process;
      • where, acting in good faith, we believe disclosure is necessary to assist in the investigation or reporting of suspected illegal or other wrongful activity; and
      • to protect and defend our rights or property.
    4. Working with other service providers and our group companies
      When transferring your personal information to our group companies, these group companies may be located within the UK, other countries in the European Economic Area or elsewhere in the world. Different privacy policies may apply in these countries and you understand and unambiguously consent to the transfer of personal information to these countries and group companies. It is possible that personal data we collect from you may be transferred, stored and/or processed outside the European Economic Area (“EEA”). By submitting your personal data, you agree to this transfer, storing and/or processing. You should be aware that countries outside the EEA may not offer the same level of data protection as the United Kingdom however we will take all reasonable steps to ensure that your data is treated securely and in accordance with this clause.
    5. Keeping Information Secure
      We take all steps reasonably necessary to ensure data is treated securely and in accordance with the Terms. We use appropriate resources to protect your personal information from loss, misuse, unauthorised access, modification or disclosure. However, we do not accept responsibility for any unauthorised or unintended access that is beyond our control.
    6. Updating your membership and preferences
      If you think any of the information we hold about you is out of date or incorrect, you may ask us to correct or remove this information, contact us at Rewards@st-enoch.com
    7. Keeping your records
      We keep records for as long as are reasonably required to run the Programme in accordance with legal and regulatory requirements. Where your information is no longer required, we will ensure that it is disposed of in a secure manner.
      You may withdraw your consent to receive marketing information at any time by emailing us at Rewards@st-enoch.com
    8. Access rights
      You may request a copy of the personal data which we hold about you, and details of how we use that information. You can request this information by contacting us at Rewards@st-enoch.com. Please note that we may, where permitted under applicable law, make a small charge/ and or request proof of identity for providing this information. In certain circumstances (for example where required or permitted by law) we might not be able to provide you with access to some of your personal information, but where appropriate we will notify you of the reasons for this.

  29. General

  30. From time to time, we may make changes to these Terms. and we will publish the updated Terms on the Website. We recommend that you check the Website regularly for any changes to the Terms.
  31. These Terms are subject to Scots law and any disputes arising out of these Terms and/or the Programme shall be subject to the non-exclusive jurisdiction of the courts of Scotland.
  32. These Terms constitute the entire agreement between us in relation to the Programme and supersede any prior arrangement, understanding or agreement between us in relation thereto.
